If I want only 5 cups to brew and I fill the water tank with 12 cups, will only 5 cups of water be used?

Definitely not! The water in the tank will drain through completely whatever amount you put in there! There is a gauge on the side of the tank to show the quantity required. Having said that, these marks may not correspond to the volume of YOUR cups or mugs. To check this, fill up your cup/mug and pour into the tank (the number of cups you wish to brew) and then see if the tank marks correspond to the quantity you wish to achieve.

I’ve recently purchased this coffee maker, but I’m disappointed with the temperature of the freshly made coffee, it just doesn’t seem hot enough.

As you say, the coffee isn't what you might call "piping hot", but that does seem to be the way it is. We have had several of these Bean to Cup machines from Cuisinart, (some different models) and they all seem to produce coffee that is maybe just a little cooler than you might prefer. In fact, if you "stir" the coffee in the pot(to mix it around) it does seem to become a bit warmer all round. We have found that after about an hour or so, we will just give the coffee (in cups) about 20 or 30 seconds in the microwave to bring it up to temperature! The pot as you know is a thermal pot which retains the heat, but there is no hot plate on these coffee makers. I think the reasoning behind that is that when coffee is sat on a hot hot plate it "burns" the coffee and makes it stale and bitter. Without the hot plate ,the coffee lasts much longer and indeed you could reheat some surplus later or even the next day and it seems fine.Overall, notwithstanding this little "deficiency", it is a great and convenient coffee maker. Just be careful (as a point of advice, from experience) not to overload the basket or grinder ,as that can cause some blockages along the way, which will lead to "overflow' to the surrounding areas. Is the on/off switch one that i can leave switched to 'on' and use a smart plug to switch the power on from my phone when i want the machine to start?

No, once the on/off button is switched on, the brewing starts.

You don't need to buy any filters.. The device has its own built in catchment basket.. It is a "gold-plated" wire mesh basket that is obviously washable. There is a water filter within the water tank which is replaceable periodically. I usually get those from Cuisinart themselves, but you might be able to find them elsewhere. BTW.. the wire basket is released by a button on the left hand side and the "gate" swings open. It is all pretty self evident once you have the machine in your hands! A great device!
